By creating an account or using the Service, you confirm that you are at least 18 years old and agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Abound is a seller outreach operating system for real estate agents. The Service provides CRM tools, email campaign management, email warmup, AI-powered lead scoring, and related features to help agents build and manage their seller pipeline.
3. Account Registration and Security
You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access or security breach.
4. Acceptable Use
You agree not to:
- Use the Service to send unsolicited spam or violate anti-spam laws (CAN-SPAM, GDPR, etc.)
- Upload or transmit malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to the Service or its infrastructure
- Use the Service for any illegal purpose or in violation of applicable laws
- Resell, sublicense, or redistribute the Service without written permission
- Interfere with or disrupt the Service or its servers and networks
- Scrape, data-mine, or extract data from the Service through automated means unless authorized via our API
5. Your Data
You retain all ownership rights to the data you submit to the Service. By using the Service, you grant us a limited license to process, store, and display your data solely for the purpose of providing the Service. We will not use your data for purposes outside the scope of our Privacy Policy.
6. Intellectual Property
The Service, including its design, features, code, documentation, campaign blueprints, and branding, is owned by Abound and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written consent.
7. Payment and Billing
Certain features require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.
- Subscription fees are billed in advance on a monthly or annual basis.
- We may change pricing with 30 days' notice. Continued use after the change constitutes acceptance.
- Failed payments may result in suspension or downgrade of your account.
8. Limitation of Liability
To the maximum extent permitted by law, Abound shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
10. Termination
You may cancel your account at any time from your account settings. We may suspend or terminate your access if you violate these Terms or for any reason with 30 days' written notice. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.
11. Indemnification
You agree to indemnify and hold harmless Abound, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after changes take effect constitutes acceptance of the updated Terms.
